What Can I Still Buy After the Hemp Ban?

21+ ONLYWhat Can I Still Buy After the Hemp Ban?
Short answer: most of what we carry is not affected. The new federal rule targets intoxicating hemp-THC products. Everything that is not built around hemp-THC -- kava, functional mushrooms, and our alcohol-free, THC-free drinks -- stays on our shelves.
Here is the plain-English version. A federal law (Public Law 119-37, Section 781) was signed on November 12, 2025 and is set to take effect approximately November 12, 2026. It caps finished hemp products at 0.4 mg total THC per container. In practice, most intoxicating hemp-THC finished products run 20 to 50 mg per serving, so those exceed the cap. The cap does not touch products that are not intoxicating hemp-THC in the first place.
So when people ask "what can I still buy," the honest split looks like this.
The Two-List Breakdown
Unaffected -- still on our shelves
- Kava -- not a hemp-THC product, not touched by the cap. Browse kava.
- Functional mushrooms -- lion's mane, reishi, cordyceps and friends. Food and dietary supplements, not affected. Browse functional mushrooms.
- Alcohol-free, THC-free drinks -- our non-THC drink lineup is unaffected. Browse alcohol-free, THC-free drinks.
- CBD isolate and broad-spectrum within the cap -- non-intoxicating CBD that stays inside the 0.4 mg total-THC limit.
- CBG, CBC and CBN -- non-intoxicating minor cannabinoids that likely survive (see the caveat below).
- Accessories -- not a consumable hemp product, not affected.
At risk under the 0.4 mg cap
- Intoxicating hemp-THC finished products over the cap -- the 0.4 mg total-THC limit is the line.
- Delta-9 hemp products above 0.4 mg total THC per container.
- Delta-8 products -- the new scope expressly captures delta-8.
- THCP and other intoxicating hemp-THC products over the cap.
- High-THCA flower -- the new plant standard counts total THC (delta-9 plus 0.877 x THCA), so high-THCA flower is captured.
The dividing line is simple: is it intoxicating hemp-THC over 0.4 mg total THC per container? If yes, it is at risk. If no, it is unaffected.
A Quick Note for Louisiana Shoppers
Rad Dad Alternative is a Louisiana company, and Louisiana has its own rules on top of the federal picture. You must be 21+ with a photo ID. State-registered hemp edibles are limited to 5 mg THC per serving, beverages to 5 mg per serving (at least 12 fl oz, one serving per container, max four per package), and tinctures to 1 mg per serving. Smokable and floral hemp and vapes are banned for Louisiana retail, and hemp sales are banned at gas stations. Compliant products must be registered with the Louisiana Department of Health and carry a QR or barcode link to a certificate of analysis.
Frequently Asked Questions
Is the hemp ban delayed or cancelled?
No. As of June 30, 2026, Public Law 119-37 Section 781 is signed and on track for an effective date of approximately November 12, 2026. On June 24, 2026 the White House asked Congress to replace or delay it, and several reform bills are pending, but none have passed. The November 12 date still stands.
What is the cap exactly?
Finished hemp products are limited to 0.4 mg total THC per container. The new plant standard measures total THC -- delta-9 plus 0.877 times THCA -- at 0.3% dry weight, and the scope expressly captures THCA and delta-8. Lab-synthesized cannabinoids such as HHC are excluded from the standard.
Will my kava, functional mushrooms, or alcohol-free drinks be affected?
No. Those are not intoxicating hemp-THC products, so the 0.4 mg total-THC cap does not apply to them. They stay on our shelves regardless. You can browse our alcohol-free, THC-free drinks, kava, and functional mushrooms any time.
What about CBD, CBG, CBC and CBN?
CBD isolate and broad-spectrum within the cap are non-intoxicating and unaffected. CBG, CBC and CBN are non-intoxicating and likely survive the cap -- we say "likely" rather than "definitely" because an FDA "similar effects" list is still pending, with CBN slightly less certain.
Which products are most at risk?
Intoxicating hemp-THC finished products over the cap: delta-9 hemp products above 0.4 mg total THC per container, delta-8 products, THCP, and high-THCA flower. Typical intoxicating servings run 20 to 50 mg, well above the 0.4 mg line.
