What Louisiana law requires of a legal seller
Louisiana regulates consumable hemp more tightly than most states, and the rules are specific enough to use as a checklist. A retailer that is following them looks like this:
- 21 and older, photo ID checked at the register. No exceptions, including for low dose drinks.
- Beverages capped at 5 mg of THC per serving, a minimum of 12 fluid ounces, one serving per container, and no more than four per package, under Louisiana R.S. 3:1482.
- Edibles capped at 5 mg per serving and 40 mg per package. Tinctures are capped at 1 mg per serving.
- Registered with the Louisiana Department of Health, with a scannable QR or barcode linking to that product's certificate of analysis.
- Sold by a permitted retailer. Hemp sales are barred at gas stations.
- No smokable or floral hemp, and no vapes. Act 752 of 2024, effective January 1, 2025, banned retail sale of inhalable hemp statewide.
