Psilocybin vs Amanita vs Functional Mushrooms: What's Actually Legal

Last updated July 10, 2026. General information, not legal advice; state and federal rules can change.

"Magic mushroom" and "mushroom gummies" get used online to describe three completely different things, with three completely different legal statuses. Psilocybin mushrooms are a federal Schedule I controlled substance, illegal to sell nationwide outside a small number of narrow, licensed state programs. Amanita muscaria is a separate wild mushroom, legal in 49 of 50 states plus Washington D.C.; Louisiana is the one exception, where it's banned for human consumption. Functional mushrooms -- Lion's Mane, Reishi, Cordyceps, and similar species -- are ordinary food-grade supplements, legal nationwide, and non-intoxicating.

Rad Dad sells only the third kind: functional mushrooms. We do not carry psilocybin or amanita products of any kind.

The three, side by side

Type What it is Legal status Effect
Psilocybin mushrooms Naturally occurring psilocybin and psilocin Federal Schedule I controlled substance. Illegal to sell nationwide, outside a small number of narrow, licensed state or city programs for supervised use. Psychedelic; alters perception. Not sold by Rad Dad.
Amanita muscaria A wild mushroom containing muscimol and ibotenic acid, chemically unrelated to psilocybin Legal in 49 of 50 states plus Washington D.C. Louisiana is the one exception: LA R.S. 40:989.1 lists it as a Schedule I hallucinogenic plant, illegal to possess, sell, or distribute for human consumption (the law carves out an exception for purely ornamental or landscaping use). Rules can change, so confirm your state's current law. Deliriant and sedative-like, unpredictable. Not sold by Rad Dad.
Functional mushrooms (Lion's Mane, Reishi, Cordyceps, and similar species) Ordinary edible or medicinal mushroom species used as food-grade supplements Legal nationwide as a supplement ingredient. Non-intoxicating. Used for everyday wellness goals like focus, calm, and energy. This is what Rad Dad carries.

Why the confusion happens

A lot of marketing language -- words like "euphoric," "magic," or "trip" -- gets applied loosely across all three categories online, even though only one of them is a federally controlled substance and none of what Rad Dad sells is psychedelic. Some brands use "euphoric" branding on functional-mushroom blends that include legal, mood-supporting ingredients alongside Lion's Mane, Reishi, or Cordyceps. That branding choice is different from the product actually containing psilocybin or amanita, and it is worth checking the actual ingredient list rather than assuming from a product name.

What Rad Dad actually carries

Every mushroom product Rad Dad sells is a functional mushroom formula -- built from species like Lion's Mane, Reishi, and Cordyceps. These are non-psychoactive, non-intoxicating, and legal nationwide as supplements. We do not carry psilocybin products or amanita muscaria products, in any form, ever. If you want the full breakdown of what each functional mushroom is generally used for, see Lion's Mane vs Reishi vs Cordyceps.

A note for Louisiana shoppers

Rad Dad is based in Louisiana, and Louisiana is actually the one state in the country that specifically restricts amanita muscaria: LA R.S. 40:989.1 (enacted 2005) lists it as a Schedule I hallucinogenic plant, illegal to possess, sell, or distribute for human consumption here (the law allows it for purely ornamental or landscaping purposes only). This page is general information, not legal advice -- state law can change, so confirm the current rule before assuming its status. It does not affect the functional mushroom products Rad Dad sells, which are a separate, legal category everywhere, including Louisiana.
